In recent years, juries have awarded patent damages in excess of $1 billion. Those awards are often challenged on appeal. In a single day last year, the Federal Circuit vacated verdicts of $85 million and $1.1 billion and remanded the cases for new trials on damages.
With so much at stake, it’s essential that the parties use an appropriate methodology to determine patent damages.
Please join partners Manuel Velez and Brian Nolan and damages expert Vincent Thomas as they discuss recent trends in the analysis of patent damages, including:
- Comparability and apportionment challenges facing experts
- Damages theories for foreign activity
- Reliance on licenses post-dating hypothetical negotiation
- Potential impact of proposed amendments to FRE 702
