It has been five years since the Hong Kong Competition Ordinance (the “Ordinance”) came into effect, during which time a number of cases have been brought to the Tribunal and Guidelines have been issued by the Competition Commission. It is becoming clear the enforcement focus of the Competition Commission is by no means limited to corporate entities, and various complaints have been pursued against individuals involved in the contravention of competition rules under the Ordinance.
