Financial Services
  • Represented multiple financial institutions in financial crisis-era litigations, in various jurisdictions, arising out of their role as securitization trustee in residential mortgage-backed securities transactions.
  • Represented Citibank in two-week bench trial and related appeal arising out of a $1 billion mistaken wire transfer, resulting in the return of all mistakenly-transferred funds.
  • Secured a significant reversal from New York’s high court for BNY Mellon and a group of co-defendant securitization trustees in a case brought by investors in certain residential mortgage-backed securities. The New York Court of Appeals found that the trustees did not have contractual or common law duties to enforce repurchase obligations against mortgage loan originators.
  • Secured a total trial victory for BNY Mellon in the first financial crisis-era case against a securitization trustee to go to trial. Reported by the financial press as a “wipeout win in first trial of noteholder claims,” the victory followed a three-week trial in Ohio state court.
