The European Union Foreign Subsidies Regulation

The Foreign Subsidies Regulation (“FSR”) came into full effect on 12 October 2023 in the European Union, introducing a new regulatory layer that parties to M&A transactions need to comply with.

The FSR will have a significant impact on businesses active in the EU, particularly with respect to increased compliance obligations and potential delays in obtaining the required regulatory approvals in M&A transactions.
