Kaitlyn Barry

As a former federal prosecutor and member of the Attorney General’s Honors Program in the Antitrust Division of the U.S. Department of Justice, Kaitlyn draws on her government experience to provide strategic counsel and vigorous advocacy across the full spectrum of complex litigation matters, including investigations, prosecutions, jury trials, bench trials, leniency applications, grand jury proceedings, and compliance programs. Kaitlyn also counsels clients in helping them develop robust programs to identify and mitigate risk before issues arise. Kaitlyn has spoken on panels across the United States discussing antitrust, investigations, compliance, and litigation issues.

Prior to joining the Department of Justice, Kaitlyn served as a law clerk to the Honorable Kurt Engelhardt at the U.S. Court of Appeals for the Fifth Circuit and the Honorable Ron Clark at the U.S. District Court for the Eastern District of Texas. She received her JD from the University of Houston Law Center and her BS from the University of Texas at Austin, where she was an NCAA Division I varsity student-athlete on the Longhorns Cross Country and Track & Field teams.

• Represented a multinational specialty chemical company in antitrust investigations by the U.S. Department of Justice and the European Commission
• Represented an individual in a U.S. Department of Justice algorithmic price-fixing investigation.
• Represented a leading real estate technology venture capital firm in a U.S. Department of Justice algorithmic price-fixing investigation.
• Represented a professional sports and commercial real estate company as a corporate victim in a criminal kickback scheme involving fraudulent payments and internal corruption.
• Represented a midstream service provider in the oil and gas sector against claims for breach of contract, fraud, and breach of fiduciary duty.
• Conducted an internal investigation for an arts and crafts retail chain after allegations of discriminatory hiring practices and a kickback scheme involving third-party vendors.
• Represented a plaintiff petroleum contract drilling company in various cases throughout Texas and Oklahoma. Cases involved contractual indemnity disputes, including under the Texas Oilfield Anti-Indemnity Act (TOAIA), insured coverage claims against excess insurers, and defense of catastrophic personal-injury and wrongful death action.
• Conducted Section 8 analysis for a multinational technology corporation, evaluating competitive practices, ensuring compliance with federal antitrust regulations, and recommending mitigation strategies.
• Represented non-profit technology trade association in an amicus brief filed in the U.S. Court of Appeals for the Ninth Circuit.
