On February 27, Mayer Brown’s New York office hosted a transactional liability insurance roundtable for insurers, brokers and other members of the transactional liability insurance ecosystem. The seminar was a “deep dive” into substantive topics in the transactional liability insurance market. The interactive discussion was geared towards industry professionals and focused on evolving trends, challenges and opportunities in the transactional liability insurance ecosystem.

The program included M&A practitioners who regularly represent both underwriters and insureds, subject-area specialists in some key issues insurers are likely to encounter in underwriting, and litigators who are highly experienced in transactional liability insurance claims. The program was led by Corporate & Securities partners Bill Kucera and Joe Castelluccio, co-leaders of Mayer Brown’s transactional liability insurance practice, and featured insights from Corporate & Securities partners Beccy Bothamley (London), Stephanie Duchene (Los Angeles) and Birgit Hübscher-Alt (Frankfurt), Litigation & Dispute Resolution partners Michelle Annunziata (New York), Joe De Simone (NY) and Bob Harrell (Houston), Government & Global Trade partner Tamer A. Soliman (Washington DC) and Tax Transactions & Consulting senior associate Chris Odell (Chicago).  The panels shared perspectives on key topics in the industry, including key substantive issues and trends in underwriting representations and warranties insurance, selected subjects that are often challenging to diligence in underwriting RWI, issues related to damages and deal valuations in RWI claims, and the migration of US-style insurance coverage into non-US markets. The Mayer Brown team was also joined by Jeffrey Mordaunt, a managing director in Stout’s forensic accounting practice.
