Amita Haylock

Amita’s practice further encompasses data protection and privacy across the APAC region, where she assists clients in developing and implementing regional compliance frameworks, responding to data incidents, conducting privacy impact assessments, and navigating cross‑border data transfer requirements. She has experience advising on data governance in highly regulated industries, including financial services, telecommunications, and technology.

Amita has extensive arbitration experience in disputes involving IP, TMT and competition law. She has acted as counsel in arbitrations administered under the rules of HKIAC, SIAC, ICC, CIETAC and the LCIA. Her work includes applications for interim relief, jurisdictional and arbitrability challenges, complex expert evidence, and the recognition and enforcement of awards.

Amita also advises on competition law issues arising from distribution and licensing strategies, dominance and market power assessments, and collaborations and joint ventures, as well as foreign investment considerations in multi‑jurisdictional transactions. She works closely with clients to align commercial objectives with regulatory expectations across diverse APAC regimes.

Amita is fluent in English, Malay, Hindi, Punjabi, and Bahasa Indonesia.

• Conducted IP and data due diligences in relation to various M&A deals. 
• Provided IP opinions for companies intending to list. 
• Advised on IP valuation, assignment, transfer and restructuring.

Telecommunications 

• Acted for a telecommunications regulator in its investigations into alleged anti-competitive conduct by Apple and certain mobile network operators. The investigation concerned the effects on competition among network operators in relation to Apple’s practice of supporting only selected network operators and configuring the iPhone 5 so that it would not connect to the network carriers that it does not support. This matter went before Court of Appeal and Court of Final Appeal. 
• Advised companies on telecommunications licensing issues.
• Advised a telecommunications regulator in relation to criminal investigations in the telecommunications sector on alleged unfair trade practices by licensees.

Media

• Acted for a free-to-air broadcaster in judicial review proceedings stemming from a decision and sanctions issued by the broadcasting regulator, in relation to product placement and indirect advertising provisions. 
• Advised a major television broadcaster and its group company on public complaints in relation to the breach of the television programme code. The complaint concerned an infotainment programme. 
• Advised an APAC media industry association on setting up a new administrative proceed to achieve site blocking in Hong Kong.

Technology 

• Advised an app-based technology company on various regulatory and licensing issues concerning the use of its app in the APAC region, including new business models, IP licences, competition law and cybersecurity and data privacy issues. 
• Advised a global technology company delivering blockchain-based solutions on the licensing of its blockchain technology into mainland China. 
• Advised a Japanese multinational information technology and electronics corporation, on legal issues arising from the assignment and licensing-back of a portfolio of technology patents between the client and several third parties, including the creation of security interests over the patents in multiple jurisdictions, with the intended objective of commercialising these patents in the United States.
• Advised a global cosmetics brand on various technological matters, including e-commerce contracts, data processing, license agreements and trading partner agreements. 
• Advised a global cosmetics brand on a privacy policy concerning use of data analytics cameras in stores to collect facial biometric data for demographics and traffic flow analysis. 
• Advised a leading investment bank on regulatory issues arising from the use of E-signature Platforms provided via servers located overseas, including cross-border data transfer considerations.
• Advised on cross-border transfer, processing, retention, storage and use of personal data. This includes advising on provisions of mainland China’s PIPL, Cybersecurity and Data Security laws. 

Competition 

• Represented an app-based technology company in investigations by the Competition Commission into anti-competitive conduct in the online food delivery sector.
• Advised a Japanese beverage and food company on IP and competition provisions in a distribution agreement. 
• Advised technology companies on licensing of their standard essential patents in mainland China, with a particular focus on Chinese anti-monopoly provisions and regulations governing technology import and export. 
• Advised an app-based technology company on public law and competition issues.
• Advised on anti-competitive provisions in distribution agreements.
• Advised a well-known real estate company on anti-competitive provision in its construction contracts.
