Brazil: ANTAQ Launches Public Consultation and Hearing on Privatization of Companhia Docas do Espírito Santo (CODESA)

The Brazilian National Agency of Waterway Transportation (ANTAQ) launched a public consultation, initiated on December 28, 2020, on the privatization of Companhia Docas do Espírito Santo (CODESA) (“CODESA Privatization Project”), pursuant to Public Hearing Notice No. 19/2020-ANTAQ (“Public Consultation”).

ANTAQ aims to obtain comments on the drafts of technical and legal documents related to the bid for the CODESA Privatization Project and the concession of the Vitória and Barra do Riacho Ports. The purpose of the bid is to transfer CODESA’s share control, through the sale of all shares held by the Brazilian Federal Government and grant the concession contract.

The CODESA Privatization Project is the first privatization of public ports in Brazil and provides for the concession of the Vitória and Barra do Riacho Ports for a period of 35 years, with a minimum mandatory investment of 1,6 billion Reais.

For the Public Consultation, ANTAQ made available the drafts of the bid invitation and the concession contract, as well as environmental, engineering and market studies, among other documents.

Comments can be sent in writing until February 10, 2021. The Public Consultation documents are available at http://web.antaq.gov.br/Sistemas/LeilaoInternetV2/PaginaPrincipal.aspx

ANTAQ also announced that an in-person public hearing will be held on a date and place to be determined.
