With the surge in ESG interest continuing globally, there is also broad, and growing, concern in the US and Europe regarding greenwashing—deceptive or misleading information or statements by companies or institutions regarding their environmental practices and impact, presented in ways that may harm investors or consumers. Thus the increased threat of greenwashing litigation and regulatory enforcement action is ever more prevalent. For Japanese corporations who are often at the forefront of ESG efforts, exposures to litigation and enforcement action is a new and disturbing risk.
