Overview

Recently named to Benchmark Litigation’s “40 & Under” list, Rory provides clients a unique combination of trial and appellate experience. Rory has served as legal issues counsel on more than a dozen jury trials, advising clients on complex legal questions and drafting key filings such as motions in limine, motions for directed verdict, jury instructions, and motions for new trial. Rory has also drafted winning appellate briefs in a multitude of courts, including the Second, Seventh, Ninth, Tenth, and Eleventh Circuit Courts of Appeal as well as several state appellate courts (including the New York Court of Appeals).

Rory leverages his background handling complex legal issues and appeals to effectively represent financial institutions, major corporations, and technology companies in a wide range of commercial disputes. Most recently, Rory helped secure a double victory for Spotify USA Inc. in a high-stakes copyright infringement matter, simultaneously defeating the infringement claim and winning a third-party indemnification claim at summary judgment after years of litigation. The decision earned the Mayer Brown team of which Rory was a core member acknowledgements in several major outlets.

Recent Experience

  • Represented Spotify USA Inc. in a copyright infringement case concerning iconic Eminem compositions, in which the district court granted summary judgment to Spotify on both the infringement claim against it and its third-party indemnification claim against a major music publishing administrator. (Eight Mile Style LLC v. Spotify USA Inc., M.D. Tenn.)
  • Currently representing a syndicate of lenders in a case arising from a power plant construction project, including briefing and arguing an appeal to New York’s Appellate Division, First Department that resulted in the dismissal of an additional claim and affirmance of the lower court’s dismissal of other claims. (Iberdrola Energy Projects v. MUFG Union Bank, N.A. et al., N.Y. Sup. Ct.)
  • Currently representing major investment management company and mortgage servicer in suite of litigations in New York state court arising from the termination of RMBS trusts.
  • Represented major property management company in class action in Oregon federal court, resulting in a favorable settlement. (Cidone v. Pinnacle Property Management, LLC, D. Oregon)
