Overview
Amy Carroll is intellectual property counsel in Mayer Brown's Washington DC office and a member of the firm’s Global Brand Management & Internet practice. Amy assists clients with the selection, protection and management of domestic and international brands and brand portfolios. Her practice also focuses on advising clients on license and services agreements involving intellectual property and conducting intellectual property due diligence and risk assessment in connection with corporate transactions.
Amy concentrates her practice on domestic and foreign trademark prosecution, trademark opposition and cancellation proceedings before the United States Patent and Trademark Office’s Trademark Trial and Appeal Board, domain name protection and enforcement strategies, advertising and marketing approvals and advising clients on games of chance and sweepstakes. She has considerable experience in drafting, reviewing and negotiating intellectual property agreements, namely, software licenses, escrow and maintenance agreements, website development agreements and trademark and copyright licenses.
Amy regularly advises clients on incentive marketing programs, including providing feedback on rules for sweepstakes and skills contests and terms for coupons, gift cards, gift certificates and rebate offers. She also provides advice on the complaint structuring and registration of sweepstakes and skills contests and on all aspects of marketing for such promotions, including print, broadcast and online advertisements.
In addition, Amy counsels clients with respect to work for hire and confidentiality arrangements and regularly conducts intellectual property audits and website audits, including drafting terms and conditions of website use and counseling on right of publicity and privacy issues in the online context.
Amy is the author of “Protecting Artistic Expression in Useful Articles: A Copyright Perspective,” prepared for the ABA/IPL Summer 2002 Intellectual Property Conference and “Not Always the Best Medicine: The Global Impact of US Patent Law,” published in the August 1995 issue of The American University Law Review. She Spoke on “Protecting Artistic Expression in Useful Articles: A Copyright Law Perspective” at the ABA/IPL Summer 2002 Intellectual Property Law Conference. She also served as a Federal Circuit editor of The American University Law Review and participated in the Concours René Cassin, a French-language international moot court competition on human rights in Strasbourg, France.
