Catherine E. Medvene

Catherine regularly advises clients on the antitrust implications of restrictive covenant programs and non-compete agreements, trade secret protection and risk mitigation, and compliance with evolving federal enforcement priorities. She has conducted comprehensive antitrust compliance training for major corporate clients and counseled multinational companies on trade secret risk assessments for cross-border transactions. Catherine also has substantial experience with government antitrust investigations, including Civil Investigative Demands and Second Requests before the DOJ and FTC, as well as complex false advertising litigation.

Catherine is an emerging leader within the American Bar Association's Section of Antitrust Law, where she serves as Young Lawyer Representative for the Unfair Competition Committee. Catherine graduated cum laude from Fordham University School of Law, where she received the "Best Brief" award at the I. Maurice Wormser Memorial Moot Court Competition and a Mediator Award at the INADR International Arbitration Competition. She also served as Associate Editor of the Fordham Journal of Corporate and Financial Law. Prior to law school, Catherine worked as a Research Associate at Economists Incorporated, conducting statistical and economic analysis in connection with antitrust, merger, and intellectual property litigation matters.

• Delivered comprehensive antitrust and trade secret compliance training for more than 400 corporate sales employees after identifying potential antitrust exposure during a trade secret investigation.
• Provided antitrust compliance counseling to a leading trade association regarding its association activities, including monitoring quarterly meetings for compliance.

Trade Secret

• Served as lead associate in the trial of a trade secret misappropriation action in federal court, securing a complete jury verdict on all nine claims, with a finding of willful and malicious conduct and full recovery of attorneys' fees and costs.
• Successfully defended an intellectual property client against a trade secret misappropriation suit, defeating a motion for a temporary restraining order.
• Conducted a comprehensive trade secret risk and remediation assessment for a multinational environmental services company involving national and multinational risks.

Other Litigation Matters

• Prepared witnesses for direct and cross-examination in connection with a two-week international commercial arbitration of a complex contract dispute valued at more than $1 billion.
• Drafted a successful summary judgment motion in a $500 million class action lawsuit.
• Represented a major construction company in a $24 million contract suit.
• Represented a state conference of the NAACP and individual voters in a federal voting rights action to prevent the purge of approximately 250,000 registered voters from state voter rolls prior to a federal election.
