Litigator of the Week Runners-Up and Shout-Outs

A team of Mayer Brown lawyers led by Nicole Saharsky, alongside Jessica Whelan of the Nevada Attorney General’s Office and Adam Hosmer-Henner of McDonald Carano, followed up their October win against Crypto.com allowing the state to continue to police sports-related event contracts with, perhaps, a bigger win last week. US District Judge Andrew Gordon in Las Vegas overturned a prior high-profile win for prediction markets operator Kalshi, dissolving his own preliminary injunction that had blocked state regulators from pursuing enforcement actions against Kalshi. Gordon wrote that Kalshi’s contention that the federal Commodity Futures Trading Commission has jurisdiction over the contracts in question would “upset decades of federalism regarding gaming regulation.” Rory Schneider and Minh Nguyen-Dang also represent the gaming board alongside members of the AG’s office. The McDonald Carano team represents the Nevada Resorts Association, which intervened in the Crypto.com and Kalshi cases.
