Hong Kong Competition Law Investigation Series – Part 9: Confidentiality During Competition Investigations

分享

The Hong Kong Competition Commission (the "Commission") generally conducts investigations in private to protect the legitimate interests of the parties involved, notably by preventing competitors from receiving access to competitively sensitive information.

Confidentiality also supports the Commission's ability to compel and obtain necessary information from companies that it investigates. The Commission will therefore not disclose confidential information, except where appropriate.

In Part 9 of this series, we will look at:

  • What is considered confidential information?
  • How to claim confidentiality?
  • Who is bound to confidentiality?
  • Confidentiality within the context of leniency applications
  • Protection of personal data
