For more than two decades, Mayer Brown has been at the center of structuring investment products for 401(k) plans. Our team works with the largest institutional asset managers in the space to develop innovative fund products that meet the evolving needs of 401(k) plans.
We bring an interdisciplinary, cross-team approach to the structuring and offering of collective investment trusts across a broad range of asset classes, including private credit, private equity, private funds, infrastructure, and real estate. Our offering extends to lifetime income products, where we have led the structure and design of the majority of the most competitive lifetime income solutions offered to 401(k) plans today, advising on the full lifecycle from product design through negotiation of annuity contracts and ancillary agreements with the nation’s most sophisticated insurance companies. Our capabilities in this space give us a leading edge in understanding market practice and a sensitivity as to what aspects of these products can give exposure to an aggressive ERISA plaintiffs’ bar or to regulatory scrutiny.
We also negotiate arrangements with managed account providers, target date fund (TDF) sponsors, platform providers, and recordkeepers to bring our clients’ products to market.
