The Constitutional Council’s decision of 10 July 2026 clarifies the scope of the right to remain silent in the context of AMF sanction proceedings, particularly with regard to the practical consequences of this decision for the individuals under investigation. Among other things, Constance discusses the need for the AMF to adapt its practice regarding the notification of grievances, as well as the vigilance to be exercised at the various stages of an investigation.
