Role of competition authorities and participants during the inspection Dawn Raids in Practice Advanced Competition Law Training

Partner Nathalie Jalabert-Doury co-led advanced competition law training on dawn raids with other practitioners and representatives from the EU Commission and several National Competition Authorities.

Nathalie’s session concentrated on the respective roles of competition authorities and the inspected company during the inspection. Nathalie discussed the powers and obligations of inspectors, the difference in the roles of NCAs during a national and a Commission inspection, the undertaking’s duty to cooperate, the limits to the 'shadowing' of Commission officials, the questions and on-the-spot interviews, and the presence of an external lawyer.

This seminar was part of ERA’s series of advanced training courses on EU competition law. It is aimed to provide a thorough and detailed overview of the conduct of dawn raids by the European Commission and national competition authorities in light of the Charter of Fundamental Rights of the EU and the case law of the CJEU and of the ECtHR. The sessions focused on the main issues that could arise at different stages of the inspection and enhance participants’ knowledge through practical exercises.
