Volodymyr Yaremko

Prior to joining Mayer Brown in 2022, Volodymyr worked in leading Ukrainian law firms, where he gained significant unique experience of advising Ukrainian and international clients in contentious cross-border matters, as well as in infrastructure, energy investment projects, and government contracts. He has been involved in Littop Enterprises Limited, Bridgemont Ventures Limited and Bordo Management Limited v. Ukraine (SCC Arbitration No. V 2015/092) in which he helped Ukraine to win its largest investment arbitration case. In this arbitration, the State of Ukraine defeated the Energy Charter Treaty claim with value of more than $6 billion filed by the minority shareholders of PJSC Ukrnafta, one of Ukraine’s largest oil and gas producers.

Volodymyr used to be a co-chair of the infrastructure committee of the American Chamber of Commerce in Ukraine in 2021-2022, and is the only Ukrainian who is certified by the FIDIC as an Adjudicator and included in the FIDIC Presidents List (2022-2028). He was admitted to the Fellowship of the Chartered Institute of Arbitrators in 2015 and was subsequently added to the approved faculty list in 2019.

Volodymyr also acts as arbitrator or adjudicator in international disputes.

He is qualified in Ukraine as attorney at law (advocate) and is admitted to practice as a solicitor in England & Wales.

• Advising a foreign participant of a major energy project in Russia in respect of avenues  and remedies in response to measures implemented by the Russian government forcing the investor to restructure its participation or exit the project.
• Advised a Middle Eastern energy company on its enforcement strategy regarding a $150 million arbitral award issued against a Ukrainian company.
• Assisting a foreign contractor in settlement with the Saudi employer of its various claims for costs related to a large municipal infrastructure project in the KSA.
• Advising an EPC-contractor from Middle East in relation to a large energy infrastructure project in Abu-Dhabi.
• Advising a Japanese supplier of equipment for a major construction project in energy industry in Russia in respect of terminating its participation in the project due to the sanctions.
• Representing the State of Ukraine in the Energy Charter Treaty investment arbitration initiated by the minority shareholders of PJSC Ukrnafta under the SCC Arbitration Rules with amount of claim exceeding USD 6 billion.*
• Acting for the State of Ukraine in the ICSID arbitration City-State N.V., Praktyka Asset Management Company LLC, Crystal-Invest LLC and Prodiz LLC v Ukraine, which was related to an alleged investment in PJSC Kreditprombank.*
• Representing the State of Ukraine in the ICSID investment arbitration initiated by Gilward Investments B.V., a shareholder of PJSC Aerosvit, with amount of claim around USD 700 million.*
• Representing the Ministry of Energy and Coal of Ukraine in two VIAC arbitration proceedings in energy export industry with total value in dispute at least USD 350 million.*
• Representing Swiss contractor in a dispute which arose from a contract for works (financed by the World Bank) with a state authority of Ukraine, under the UNCITRAL Arbitration Rules administrated by the Permanent Court of Arbitration in the Hague.*
• Providing advice to an US contractor in relation to targeting Ukrainian market and a huge USD multi-billion potential road infrastructure project in particular.*
• Advising on various issues, including dispute resolution strategy, related to the implementation of a major rail construction project in the Western Ukraine – Beskyd Tunnel – based on FIDIC form of contract (Yellow Book).
• Representing of Risoil, and its partners from Georgian Industrial Group, in two pilot tenders for the concession of Kherson and Olvia seaports in Ukraine.*
• Assisting a foreign investor in exploring PPP models of cooperation with Ukrainian municipalities in water and waste management sectors.*
• Acting for US commodity trader in relation to expending its operation in Odesa sea-port, including assisting in land allocation, lease of state property and construction permits procedures.*
