Carolina’s current and recent relevant experience includes:

  • Representing a major Brazilian oil and gas company, as claimant, in an LCIA arbitration arising out of a Joint Operating Agreement and a related Participation Agreement concerning the development of offshore oil fields in Brazil. The dispute relates to the shared use of an FPSO for the development of a unitization area and involves issues concerning contractual waivers, exclusive operations, spare production capacity, and the execution of unitization arrangements required by the Brazilian oil and gas regulator (ANP). The arbitration is seated in London, Brazilian law is applicable to the merits, and English is the language of the proceedings.
  • Representing one of Mexico’s largest companies in an ICC arbitration against multiple investment funds and project companies. The dispute concerns the development and operation of two large-scale photovoltaic power plants in Mexico and involves claims for unpaid fees and related contractual obligations. Mexican law is applicable to the merits, Mexico City is the seat of the arbitration, and Spanish and English are the languages of the proceedings.
  • Representing a Spanish EPC contractor and its Ivorian subsidiary, as claimants, in an ICC arbitration seated in Paris against the Ivorian subsidiary of a French company. The dispute relates to the construction of a combined-cycle power plant and the impacts of force majeure events on the performance of the works. French law is applicable to the merits of the dispute, and French is the language of the proceedings.
  • Representing a major Brazilian infrastructure company and its subsidiary in a high-stakes CAM-CCBC arbitration seated in São Paulo against a prominent French corporation and its Peruvian subsidiary. The dispute arises out of a Share Purchase Agreement relating to the sale of an interest in a Peruvian toll road concessionaire and involves claims concerning alleged breaches of representations and warranties. The dispute overlaps with three parallel arbitrations, including two arbitrations seated in Paris and one ICSID arbitration. Brazilian law is applicable to the merits, and English is the language of the arbitration.
