Michelle Orgera is an associate in Mayer Brown's New York office and a member of the Restructuring practice. She advises various types of clients including debtors, administrative agents, secured lenders, international and domestic financial institution creditors, and other interested parties in a range of in-court and out-of-court restructurings. Her experience spans chapter 11 proceedings, debtor-in-possession financings, restructuring of credit facilities, federal monitorship, and multi-jurisdictional matters across the technology, energy, and transportation industries.

Experiencia

Represented:

  • The largest group of contract parties/customers (by megawatt hours) in contentious and successful litigation regarding intellectual property rights of such customers in the Chapter 11 filed in the District of New Jersey of Powin LLC, an Oregon-based battery manufacturer and supplier.
  • Administrative agent of the approximately $600 million pre-petition senior secured facility and of the $105 million secured DIP financing in the chapter 11 case of Ebix, Inc., in the Northern District of Texas.
  • Administrative agent under a syndicated secured loan facility, in connection with the prearranged chapter 11 cases of Salem Harbor Power Development LP and certain of its affiliates, owner of a gas-fired power plant in Massachusetts. This restructuring was awarded “Energy Restructuring of the Year” at Global M&A Network’s 2023 Annual Turnaround Atlas Awards.
  • A major Brazilian bank, as the secured lender, in connection with a chapter 15 bankruptcy.
