    False Claims Act: Current DOJ Priorities and Developments in the Law

    Long used to recoup payments (and damages) stemming from health care fraud and government contracts, the False Claims Act is now front and center as the Trump Administration’s tool to enforce tariffs and policies on DEI and gender affirming care. We’ll discuss best practices applicable across areas of the law and how to mitigate the risk of qui tam actions.

    Cross-Border Enforcement Challenges

    A string of announcements since the start of the Trump Administration have outlined a new set of priorities for cross-border enforcement, with a focus on the “total elimination” of drug trafficking cartels and transnational criminal organizations. Those announcements included a reset of priorities for white collar criminal and corporate enforcement. We will address how the Trump Administration’s priorities are operating in practice, and how companies can and should re-orient their own compliance priorities towards the changing risk environment.

    Cybersecurity enforcement has proven to be a bipartisan priority. At the federal level, agencies such as the DOJ and SEC have continued to declare cybersecurity a top concern. State-level enforcement by attorneys general and regulators is also on the rise. In this discussion, we will cover significant trends in cybersecurity and related enforcement, highlight what regulators are focusing on, and provide guidance on how to avoid becoming a target.

    Securities Enforcement Trends: BSA/AML Risks for Financial Institutions and Broker-Dealers

    Securities enforcement is increasingly converging with BSA/AML priorities, with the SEC, FINRA, FinCEN, and DOJ leveraging data analytics and cross-agency coordination to target alleged program deficiencies, weak surveillance, and delayed or inadequate SAR filings—especially around alleged sanctions evasion, microcap/manipulative trading, and high-risk cross border activity. This panel will discuss the need for financial institutions, broker-dealers, underwriters, and auditors to understand the risk of heightened scrutiny of their BSA/AML practices, including the anticipated impact of the SEC’s new cross-border task force.
