Preparing for China’s New Export Control Law: Strategic Considerations for Global Businesses

On December 28, 2019, the National People’s Congress of the People’s Republic of China issued a new draft of the Export Control Law, an update from the 2017 version released by the Ministry of Commerce (MOFCOM). 

May 25, 2020 Update: The Chairman of the Standing Committee of the National People’s Congress announced that the Export Control Law will be one of China’s legislative priorities for 2020. Given recent developments in the United States and China, the new law merits careful consideration by global companies operating in both jurisdictions. 

As China’s first comprehensive export control legislation, this represents a major shift in China’s export control framework, currently composed of disparate administrative regulations creating some difficulties with enforcement. The new draft law reflects certain principles in other jurisdictions’ export control laws but also contains many China-specific elements.
