"The Republican Party has quickly gotten onboard that train," said Matthew Bisanz, partner at Mayer Brown. "ESG is one of the areas where Biden wants to move forward, but he will likely face strong opposition from red states, which typically say that progress in this area should happen through existing and clearly established rules of law."

"There is a way out of this antitrust vs. ESG conundrum, but it needs to be done in a thoughtful manner that doesn't impose obligations on companies or make business decisions through a collective,"  said Bisanz. "It can be done, but it will take longer and can't be as hard-coded and coordinated."
