This presentation will focus on emerging issues related to the attorney-client privilege in the context of discovery obtained in white collar government investigations through search warrants or other means. With the continued expansion of digital evidence seized during the execution of search warrants, the amount of potentially privileged material involved in searches in white collar cases has become larger than ever before. In recent years, there have been a number of court decisions around the country that have addressed the U.S. Department of Justice’s procedures for handling privileged material that is seized during government investigations. This panel discussion will address issues related to the government’s seizure of attorney-client privileged materials, notable court decisions addressing the government’s handling of privileged materials, and the approaches taken in recent high-profile cases involving the seizure of such materials, including the investigations of attorneys Michael Cohen and Rudy Giuliani.
