Who’s to Blame? Bank Liability for Third-Party Wrongdoing

Banks are increasingly in the line of fire for civil claims alleging that they should have spotted or that they turned a blind eye toward, or even assisted in the misconduct of third parties. In this presentation, we will explore the various theories of liability that a plaintiff may assert in an attempt to hold a bank liable for third-party fraud or other misconduct and discuss recent developments in the case law on these issues. We will consider how the approach of courts and regulators to these types of claims may differ between the US and the UK and the potential implications that these differences can have for banks' liability to their customers and other parties where money is being transferred across borders.
