Section 5 Under Trump: Dead or Alive?

With retention of the 2022 Section 5 Policy Statement, but the FTC’s decision not to defend the non-compete rule and repeal of President Biden’s Executive Order on Promoting Competition in the American Economy, the Republican-controlled FTC and Trump Administration have sent mixed signals on the Administration’s enforcement intent for Section 5’s prohibition of unfair methods of competition. This panel discussed the potential direction of Section 5 policy over the next three years and what this means for the business community.
