As ransomware attacks and other sophisticated cyber attacks continue to surge and impact some of the nation’s largest companies, the Biden administration is showing a significant interest in cybersecurity. Federal agencies have taken increasingly active roles in not only responding to cyber attacks but also proposing affirmative rules, obligations and other means to expand the federal government’s oversight of private companies’ cybersecurity. In the enforcement context, this has meant a growing number of probes and actions against companies, such as the SEC’s widely publicized inquiry into the SolarWinds incident. As the legal landscape continues to evolve, companies should continue to expect heightened scrutiny of their management of cyber risks, added reporting obligations and increased regulatory and litigation risk.
