Gustavo Scheffer da Silveira advises and represents clients in high-stakes, complex litigation, and arbitration matters. Gustavo represents clients in national and international arbitrations, focusing on disputes in the civil construction, energy and technology sectors. He is an arbitrator in international arbitrations administered under the rules of international and regional institutions.
Gustavo’s previous work experience provides him with knowledge to best serve clients in the domestic and international arbitration sector. He worked as Deputy Counsel in the Latin American team, as counsel responsible for the São Paulo office of the ICC’s Secretariat of the Court, managed hundreds of cases, and reviewed arbitration awards relating to various jurisdictions and economic sectors.
Gustavo sits as arbitrator in international arbitrations administered under the rules of international and regional institutions. He is fluent in English, French, Portuguese, Spanish, and German.
Expérience
Gustavo’s current and recent relevant cases include the representation of:
- The bankrupt estate of one of the largest construction and oil & gas companies in Brazil, in an LCIA arbitration against the largest Brazilian state-owned oil & gas company. The dispute concerns the termination of two contracts related to deepwater drilling for oil exploration in Brazil, following allegations of corruption and non-payment. One contract is a capital lease agreement for a drillship, and the other is a drilling services contract for the operation of that drillship in Brazilian waters, with an amount in dispute of over USD 2.4 billion. The contracts are governed by the laws of England and Wales, London is the seat of the arbitration, and the proceedings are conducted in English.
- Representation of a leading global agribusiness company in an ICC arbitration against a major Asian conglomerate and its affiliated private equity fund. The dispute concerns the termination of a share purchase agreement for the acquisition of 100% of a Brazilian soy protein producer, following alleged post-signing deviations from the ordinary course of business and related contractual breaches. The agreement is governed by Brazilian law, São Paulo is the seat of the arbitration, and the proceedings are conducted in English.
- One of Mexico’s largest companies in an ICC arbitration against multiple investment funds and project companies. The dispute concerns the development and operation of two large-scale photovoltaic power plants in Mexico, involving claims for unpaid fees and related contractual obligations. The contracts are governed by Mexican law, Mexico City is the seat of the arbitration, and the proceedings are conducted in Spanish and English.
