Mayer Brown launches cross-disciplinary AI Task Force to advise on business opportunities and risk mitigation

Artificial intelligence (AI) is creating dynamic new opportunities and challenges for developers, investors and users alike. In order to help clients navigate these new paths and complexities, Mayer Brown has launched a cross-practice AI Task Force.

“Clients across industry sectors and geographies are increasingly turning to us to advise on a range of issues emerging from the rapidly evolving legal and regulatory environment of AI,” said Raj De, a member of the firm’s global Management Committee and leader of the firm’s AI Task Force. “Our integrated international firm and deep industry experience provide clients with a holistic approach to address their immediate legal and business needs and help them understand long-term implications of AI on their key products, services and markets.”

The multidisciplinary AI team comprises more than 60 lawyers across the firm’s key regions with experience in cybersecurity and data privacy; intellectual property; technology transactions; corporate; dispute resolution; regulatory; employment law; AI governance and ethics.

The team addresses the spectrum of AI-related matters and issues, including:

• Cybersecurity and Data Privacy: Advising on the full spectrum of cybersecurity and data privacy considerations associated with development and deployment of AI tools, cross-border data transfers, and data innovation and governance considerations.

• Intellectual Property: Protecting AI innovations, training data and outputs through strategic intellectual property management and enforcement.

• Technology Transactions: Drafting, reviewing and negotiating contracts involving AI, including data license agreements, cloud service agreements, AI systems development and integration agreements and agreements for AI-powered products and services.

• Corporate: Preparing agreements for equity investments, joint ventures, mergers, acquisitions, divestitures and other corporate transactions for AI companies.

• Governance and Regulatory Compliance: Advising boards of directors and management teams regarding risk management strategies and navigating the complex and evolving landscape of AI regulations and standards.

• Data Ethics and Fairness: Advising on ethical considerations surrounding development and use of AI technology, including fairness, transparency, accountability and bias mitigation, including with respect to employment discrimination and fair lending.

The Task Force’s AI law thought leaders have issued more than 60 recent legal updates on cutting-edge AI topics; published in respected sites such as the Harvard Law School Forum on Corporate Governance (“Generative Artificial Intelligence and Corporate Boards: Cautions and Considerations”) and The Conference Board (“How CEOs and Boards can Enhance Digital Trust”); and hosted events on a range of timely topics, including the Digital Trust Summit in March 2023 for CEOs and board members concerning generative AI, and an April 2023 conference on the subject of “Protecting AI Inventions through Intellectual Property.”

A further testament to the team’s leadership in the AI space, partner Dominique Shelton Leipzig was recently appointed to the International Association of Privacy Professionals’ (IAPP) AI Governance Center Advisory Board, and partner Arsen Kourinian is actively working with the IAPP’s professional training and education taskforce to develop the first certification exam for artificial intelligence governance.
