To Market or Not to Market? Outsourced Service Provider Convicted for Breach of Direct Marketing Provisions

Gabriela Kennedy’s Asia-Pacific column in the October issue of Computer Law & Security Review features the Mayer Brown article ‘To Market or Not to Market? Outsourced Service Provider Convicted for Breach of Direct Marketing Provisions’.

In this article, she provided an analysis on the conviction of an outsourced service provider which is a marketing company for the breach of direct marketing provisions under the Hong Kong Personal Data (Privacy) Ordinance (PDPO). Gabriela explained that this case will likely result in the tightening of relevant provisions in data processing or marketing agreements, and will no doubt cause marketing companies and other data processors to review their terms of business and revisit procedures regarding the maintenance of opt-out lists.
