Overview

Kyle J. TumSuden is an associate in Mayer Brown's Chicago office and a member of the firm’s Restructuring practice.  Kyle represents debtors, lenders, agents, bank groups, purchasers, trustees, trade creditors, and other parties-in-interest in chapter 11 cases, non-bankruptcy insolvency proceedings, out-of-court restructurings and workouts, enforcement actions, and other distressed situations.  

Prior to joining Mayer Brown, Kyle worked at a leading firm in New York focusing on company-side chapter 11 cases and out-of-court restructurings.  

Experience

  • Represented one of the largest retailers in the world in connection with its chapter 11 cases involving approximately $6 billion in debt; was the largest retail bankruptcy in history at the time of filing.
  • Represented leading oil and natural gas exploration and production company in its chapter 11 cases involving approximately $4.9 billion in funded debt obligations.
  • Represented independent directors of once-preeminent toy retailer in connection with its chapter 11 cases.  
  • Represented ad hoc group of secured lenders in acquisition of distressed specialty retailer.
  • Represented domestic coal producer in connection with asset sale and various liability management transactions, and attendant securities law and corporate governance matters.
  • Represented independent directors of distressed specialty retailer in connection with various liability management transactions.  
  • Represented two San Francisco-based private equity firms in defense of substantial chapter 11 avoidance actions.
  • Represented equity sponsor in connection with out-of-court restructuring of portfolio company.
  • Represented leading domestic media corporation in its wind-down and dissolution under Delaware law.
  • Represented indenture trustee in out-of-court restructuring of domestic manufacturer involving $2 billion of funded indebtedness.
  • Represented premier foreign bank in connection with asset recovery and enforcement proceedings.
  • Represented international technology-parts manufacturer with respect to potential chapter 11 avoidance actions.
  • Represented official committee of unsecured creditors in chapter 11 cases of the world’s largest private coal producer.
  • Represented joint liquidators appointed in the British Virgin Islands on behalf of certain “feeder” funds in connection with chapter 11 cases of investment vehicles.
