The European Commission has identified Artificial Intelligence as a key element of European competitiveness. Other jurisdictions like the US, UK, and China have also made it a cornerstone of their industrial policy and are taking steps to make themselves more welcoming to AI development. During this conference, our highly esteemed speakers will unpack the key issues involved in the AI, Copyright + Access to data space, considering how traditional and new competition and regulatory rules might be applied in a way that promotes European AI development while protecting creative works. This debate is particularly timely as it allows us to reflect on several related consultations that the EC has initiated, including the Apply AI Strategy, and the Data Union Strategy, in the context of the AI Continent Action Plan. AI focuses the IP/Competition debate on the digital future, where on the one hand innovation requires enabling more digital players, big and small alike, but on the other hand heightens demands for more robust protection of legacy industries and individual copyright holders. Key topics to be discussed from the perspective of leading tech businesses, economists and lawyers include: How does copyright apply to the AI value stack? Access to data – at what cost? Unlocking the labyrinth – is licensing a real way out?
