Over the course of this series, we will report on the main 2024 developments relevant to capital markets, structured products, derivatives, and financial regulatory practitioners.

Our third webinar will focus on Own Funds and Eligible Liabilities: Lessons Learned from EBA’s Monitoring Reports

In July 2023, EBA updated its monitoring report on AT1, Tier 2 as well as TLAC and MREL instruments and merged the previous two reports for Own Funds and Eligible Liabilities into one report. EBA also added new recommendations on certain contractual clauses of the corresponding documentation. With these changes, EBA began aligning certain Own Funds and Eligible Liabilities elements. In addition, EBA continued to release Q&As on both regimes for Own Funds and Eligible Liabilities and started publishing letters on certain eligibility issues of outstanding instruments.

In our webinar, we will discuss the first practical experiences with the application of the new monitoring report and summarise the current recommendations and Q&A landscape, with a particular focus on Tier 2 and Eligible Liabilities and analyse the impact of the current and future monitoring reports for banks for new issuances, as well as outstanding instruments or consent solicitations.
