Position Marks in Brazil: Now a Reality

Position mark registration, already a reality in other countries, will now also be available in Brazil. Ordinance No. 37/2021, recently published by the BPTO (Brazilian Patent and Trademark Office), outlines the registration conditions. This new development represents, in addition to greater protection for the products and assets of trademark holders in Brazil, the increasing sophistication of the national system for trademark regulation.
