Mayer Brown secures trial victory for Maxell in patent infringement case

3 July 2018

Mayer Brown secured a victory before the Eastern District of Texas’s Texarkana Division on behalf of Maxell, Ltd. in a patent infringement case against ZTE USA, Inc. The litigation involved seven patents directed towards smartphone and tablet technology including navigation, power management, audio and camera features.

On June 29, after a 10-day trial, the jury returned a verdict finding that each of the seven patents was infringed by ZTE and awarding Maxell $43.3 million in damages. The jury also found willful infringement by ZTE, for which Eastern District of Texas Judge Robert Schroeder III will assess enhanced damages at a later date. On July 2, shortly after the jury verdict, the United States Patent and Trademark Office (USPTO) Patent Trial and Appeal Board denied the seventh and final Inter Partes Review filed by ZTE on the patents, underscoring the strength of the patents as determined by both the USPTO and the jury. This massive victory for Maxell ends several years of hard-fought litigation.

The trial team was led by Mayer Brown Washington DC-based Intellectual Property partners Jamie Beaber, Alan Grimaldi and Kfir Levy and counsel Tripp Fussell and included lawyers from the firm’s Intellectual Property and Litigation & Dispute Resolution practices in Washington DC and Chicago. Patton Tidwell & Culbertson LLP’s Geoff Culbertson served as local counsel.
