Too high a price? The perilous combination of statutory damages and class certification

For certain causes of action, Congress has provided that plaintiffs may seek statutorily defined damages, rather than proving actual damages. When combined with the class-action procedure, these statutory damages provisions sometimes create a risk of staggeringly large awards — often for merely technical violations of a statute.
