The Food and Health Bureau of the Government of the Hong Kong Special Administrative Region recently published an invitation for expressions of interest for the development of private hospitals in Hong Kong. A copy of the invitation is attached.
According to the invitation, the Hong Kong Government is considering making available four sites in Hong Kong for the development of hospitals and is seeking "information, ideas and suggestions" from interested parties.
The Government may consider structuring the developments on a "PPP" basis by which the Government may provide land for proponents to finance, design, construct and operate the hospitals for a specified concession period.
Other development structures may also be considered by the Government.
JSM has acted on numerous PPP style projects in Hong Kong over the years and has well established relationships with the medical and health regulatory authorities in Hong Kong.
We have in depth experience in dealing with the issues relevant in the structuring of such projects including:
- Advising on land title and the provisions of Private Treaty Grants from the HKSAR Government.
- Drafting and negotiating concession or BOT type agreements with the HKSAR Government.
- Drafting and negotiating documentation for project finance.
- Drafting and negotiating consultancy and building/construction contracts for new developments and facilities.
- Drafting and negotiating operation and maintenance agreements.
We would be delighted to provide advice and assistance to interested parties in the preparation and submission of expressions of interest in response to the Invitation and in any subsequent invitations to tender that may be issued by the Hong Kong SAR Government for these projects.
Please do not hesitate to contact Mr Kevin Owen at +852 2843 4408 or Mr Andrew MacGeoch at +852 2843 2253 if you would like any further information in relation to JSM's experience and capabilities in this area or if we can be of any assistance to you generally in relation to the Invitation.
