Second Circuit Rules District Court Judge Lacked Jurisdiction to Hear Dispute Over KPMG's Failure to Pay Defendants' Attorney's Fees

In one of the most watched federal criminal cases of the year, on Tuesday, May 23, 2007, the U.S. Court of Appeals for the Second Circuit in New York found that District Judge Lewis Kaplan lacked jurisdiction to oversee an attorney fee dispute between KPMG and former employees and partners who were indicted and charged with promoting illegal tax shelters in what has been characterized as the largest tax prosecution in history.
