Criticism has been directed at the US government’s perceived policy requiring waiver of an investigated entity’s attorneyclient and work-product privileges as a condition of being deemed cooperative. We trace the history of this perceived policy, review recently proposed legislative solutions, and address factors to consider during an investigation.
