Spring 2007 - In the wake of the U.S. Supreme Court's opinion in Burlington Northern & Santa Fe Railway Co. v. White, 126 S. Ct. 2405 (2006), lower courts have begun to use the objective standard applied in Burlington to dismiss weak retaliation cases on summary judgment.
