21 May 2007
Mayer Brown Legal Update

Friday 13 July will be the day on which the new provisions concerning calculation of certain statutory benefits will come into force. This gives employers less than 2 months to revise their payroll systems. JSM has prepared a note to assist employers in this process.

Full Update

We have prepared a note on the implications of the Employment (Amendment) Ordinance 2007. This is available from the following link:

JSM Note on Employment (Amendment) Ordinance 2007

There are a number of questions which remain unanswered. These include:

  • what happens when an employee moves from full time to part time, or vice versa (or otherwise changes his or her working hours)?
  • where an employee is paid monthly how do you calculate whether an employee receives his or her "full wages" for a day of leave?

No doubt these questions (and plenty more) will be decided by the courts in due course.
