Tender Contracts - Duties of Fairness and Good Faith

The decision in Gerald Martin & Others v Belfast Education and Library Board (a decision of the Northern Ireland High Court) confirms that a "tender contract" can be implied between a prospective employer and a tenderer for public works contracts and that the Employer will have duties to act fairly and in good faith during the tender process.
