Tom Duncan is a partner in the London office of Mayer Brown's Construction & Engineering and International Arbitration groups. He advises clients (including employers, contractors, engineers, suppliers and insurers) on all aspects of construction and engineering law, with a particular focus on the resolution of complex disputes.
Tom advises on disputes under various forms of contract (including FIDIC, IChemE, NEC, ICE, SoPC4 and JCT) and in many different sectors (road, rail, ports, oil and gas, waste to energy, offshore wind and other alternative energy, waste water, sports stadia, and commercial, retail and residential development).
Tom also has extensive experience advising insurers and professionals in construction related professional indemnity claims; indeed the team remains "an incredibly strong force in the field of professional negligence" and Tom is recommended by Legal 500. He advises insurers on policy coverage under many types of construction policy, including professional indemnity, public liability and CAR policies and defends consultants and design and build contractors from professional negligence claims in the pre-action stages and in litigation and arbitration proceedings.
He has represented clients in a number of different jurisdictions in the Middle East, Continental Europe, Africa and Asia and has experience of all forms of arbitrations, adjudications and other forms of alternative dispute resolution. He has acted on UNCITRAL, ICC and LCIA arbitrations and in the High Court (TCC) in London. Tom’s role often involves working with clients to manage their risks during the course of the design and construction of a project to either avoid disputes or ensure that the client is best placed if a dispute does arise.
