Ruth Lane is a senior associate in the Insurance and Reinsurance practice of the London office, working with both the Lloyd’s and companies markets. She joined Mayer Brown in 2011, having worked previously for another international law firm and in-house at a major London market reinsurer for two years, following qualification in 2008.
Ruth has extensive experience of advising insurers on a variety of high value, complex D&O, professional indemnity, warranty and indemnity and political risk claims, often involving parties, authorities and litigation in a number of jurisdictions. She advises regularly on complex policy issues regarding the validity and application of insurance contracts including issues of non-disclosure, misrepresentation, attachment and aggregation. Ruth has also acted for many insured entities in concluding professional negligence claims.
Directors' & Officers' Insurance: Ruth has advised primary and excess layer insurers on a number of sensitive and high-profile D&O claims, brought against the directors of leading multi-national companies. These claims encompass wide-ranging regulatory investigations, and civil and criminal proceedings in the UK and overseas. She has particular experience of claims brought against directors under s.90 FSMA 2000, for alleged misleading statements in rights issue prospectuses, including those which involve contribution claims against the directors of the policyholder’s subsidiaries.
Professional Indemnity: Ruth regularly advises insurers and their insureds to conclude sensitive claims brought against a variety of professionals, with a particular emphasis on claims against surveyors and solicitors. Such claims are often settled in the pre-action stages, by mediation or other without prejudice negotiations. Many such cases have involved successful contribution claims against third parties.
Political Risk Insurance: Ruth advises political risk insurers in relation to coverage issues, and the adjustment and defence of claims involving many types of political risk policies, including contract frustration, non-payment and charterparty default insurance. Many of these cases involve other jurisdictions and Ruth is highly experienced in dealing with foreign lawyers, experts and brokers.
Warranty and Indemnity Insurance: Ruth is part of a growing team at Mayer Brown advising insurers on warranty & indemnity notifications, including those which involve accounting and tax elements together with foreign law considerations.
