David Rome is an associate in Mayer Brown’s Washington DC office and a member of the Intellectual Property practice. David’s practice focuses on brands, content, information and the internet. He has experience with clients in a wide variety of industries, including technology, finance, pharmaceuticals, media, fashion and publishing. He handles an array of issues involving copyright, trademark, publicity, unfair competition, advertising, trade secret and privacy law.

David advises clients on the development and implementation of global trademark portfolio and enforcement strategies. He oversees a worldwide network of associates and coordinates their efforts to secure and protect trademark assets. He also performs trademark clearance and prosecutes applications before the United States Patent and Trademark Office (USPTO). David litigates trademark oppositions and cancellations before the USPTO’s Trademark Trial and Appeal Board (TTAB) and, more generally, advises clients on how to reinforce the strength and value of their existing trademark assets.

David also provides advice on how to safely and effectively put valuable intellectual property to good use. He drafts and negotiates agreements concerning creative content, trademarks, data and proprietary information. These often relate to the secure development of new and innovative goods and services. David advises clients on laws, regulations and industry self-regulation applicable to advertising in traditional and new media. He helps to develop and launch promotional campaigns by preparing talent, sponsorship and representation agreements that allow clients leverage endorsements, influencers, spokespeople and events to reach their customers and promote their brands.

In his work with Mayer Brown’s internet practice, David enables clients to maintain a secure presence on all levels of the domain name system (DNS). He handles domain name disputes involving the Internet Corporation for Assigned Names and Numbers (ICANN) Uniform Domain Name Dispute Resolution Policy (UDRP) and procedures specific to country-code top-level domains (ccTLDs). David advises clients on use of other ICANN rights protection mechanisms, such as the Uniform Rapid Suspension System (URS), Public Interest Commitment Dispute Resolution Procedure (PICDRP) and the Trademark Post-Delegation Dispute Resolution Procedure (PDDRP) applicable to some generic top-level domains (gTLDs). He also assists registry operators with the delegation, launch and maintenance of gTLDs, including “.BRAND” gTLDs. David develops domain name portfolio strategies and enforcement programs, which includes advice on the use of the Trademark Clearinghouse (TMCH) and its attendant claims notice and new gTLD “sunrise” registration systems as well as registry operators’ voluntary rights protections mechanisms such as domains protected marks lists (DPML).

David has a substantial background in litigation and experience in disputes regarding copyright, trademark, trade dress, gray market imports and unfair competition matters in federal courts. He has also litigated matters involving publishing agreements and trade secrets in state courts.
