Andrew McGahey is a partner in the London office of Mayer Brown’s Insurance & Reinsurance Industry Group. He has extensive experience of advising insurers on claims involving directors and officers, financial institutions and professionals. Andrew also advises insurers on claims under warranty and indemnity and POSI policies and is a key member of the Firm's corporate insurance team, with extensive experience of advising of transactional liability insurance matters.
Directors' and Officers' Liability
Andrew’s D&O practice includes advising insurers on claims brought against the directors of leading multi-national FTSE 100 and 250 companies, which can involve advising on complex allocation of loss issues, the application of dishonesty exclusions, and alternative interim funding arrangements.
He also defends directors in breach of duty claims and in directors' disqualification proceedings, where Andrew is currently representing a client before the English High Court.
His financial institutions practice includes advising insurers on complex first party and third party losses, involving banks, private equity houses, stockbrokers, investment managers and advisers located both in the UK and Worldwide, and he has advised on what was then the largest first party loss in the London market as well as the notorious split capital investment fund crisis. As well as advising insurers, Andrew also regularly represents investment managers in claims brought against them for breach of contract, including breach of confidence.
Transactional Liability Insurance
Andrew is a key member of the Insurance group. He advises clients on the wordings of warranty and indemnity insurance policies and has advised on "title and no search indemnity" insurance policies for multi-million pound distressed property portfolio acquisitions. Andrew has also performed dozens of insurance due diligence reviews for clients acquiring other businesses and has developed new transactional liability insurance products for London market insurers, including capital relief products.
