Mark C. Hilgard is a partner in the Frankfurt office of Mayer Brown's Litigation & Dispute Resolution practice. He leads the litigation and arbitration practice of Mayer Brown in Germany. He has an extensive multinational practice in which he focuses on a broad range of commercial litigation and arbitration as well as on merger and acquisition transactions. Mark has extensive experience in both national and international litigation and arbitration. Many of his arbitral proceedings are held before international tribunals, with a significant number conducted in the English language. Having handled transnational and international litigation and arbitration for over 30 years, he has an in-depth familiarity with the laws and legal systems of other countries.
Litigious and arbitral matters in which Mark has represented clients or in which he acted as arbitrator include post -M&A disputes, contractual disputes, complex liability cases, cartel law disputes, and plant engineering and construction controversies. Mark regularly undertakes litigation involving matters that are very complex or that require particular technical understanding. He has represented clients in cross-border litigation and arbitration (mainly ICC, DIS and ad hoc proceedings) involving construction projects or energy-related matters in Europe, Latin America and the United States.
Mark is admitted to all municipal courts (Amtsgericht), regional courts (Landgericht) as well as at all courts of appeal (Oberlandesgericht) in Germany. During his career, he has advised and represented several clients in proceedings up to the German Federal Supreme Court (BGH) and the European Court of Justice (Europäischer Gerichtshof). In corporate and commercial matters Mark has a particular emphasis on mergers and acquisitions. He regularly advises several clients on a wide range of acquisitions in Germany and throughout Europe as well as in restructuring of subsidiaries.
