Victor Zhao and Anne Kersch, Associates in the Houston Office, will join Charles Roth of the National Immigrant Justice Center in representing Arturo Escobar Barraza (Escobar Barraza v. Gonzales, Docket No. 07-2502) who is appealing an order of removal entered by the Board of Immigration Appeals. Mr. Escobar is a 29 year-old Mexican national who has lived in the United States since he was one. In seeking permanent residency on the basis of his marriage to a United States citizen, Mr. Escobar was placed in removal proceedings for prior felony convictions. The appeal centers on (1) whether a conviction for the possession of a marijuana pipe is a conviction related to controlled substances so as to permanently bar Mr. Escobar from the United States; (2) whether the conviction would otherwise fall into an exception for possession of less than 30 grams of marijuana; and (3) whether permanently barring Mr. Escobar from the United States based on his conviction is an absurd result that must be avoided so as to comport with legislative intent.Brett Busby, a partner in the Houston Office, will supervise.
