Mayer Brown wins motion to transfer food flavoringcases against Chemtura to federal bankruptcy court

A US District Court judge has granted a motion by Mayer Brown, a leading global law firm, to consolidate and transfer claims from 16 state and federal food flavoring cases against Chemtura Corporation, Chemtura Canada and Citrus & Allied Essences to the Southern District of New York, the jurisdiction of the bankruptcy court overseeing Chemtura’s bankruptcy proceedings.

The 16 cases were filed by a variety of plaintiffs who allege that they suffered respiratory damages due to exposure to a food flavoring ingredient manufactured by Chemtura Canada. The cases were filed in both state and federal court in eight states, and are among more than 300 such cases pending nationwide against food flavorings manufacturers. These cases have been referred to in the media as the “popcorn lung” cases.

“We are pleased the Court agreed to consolidate these various claims,” said Mark Ter Molen, the Mayer Brown partner who led the firm’s representation of Chemtura. “Consolidating these cases will allow them to be adjudicated more efficiently, and transferring jurisdiction to the federal bankruptcy court will ensure that the cases are heard by a judge who is knowledgeable about the full range of issues involved.”
