Mayer Brown partner Robert P. Davis
named a 2011 “Employment MVP” by Law360

Mayer Brown, a leading global law firm, announced  that Robert P. Davis, a partner in the firm’s New York Litigation & Dispute Resolution practice, was named an “Employment MVP” by Law360. He is one of five influential attorneys the publication honored who in 2011 “made the most significant contributions in employment law and secured big wins.”

The Law360 article  highlighted Mr. Davis’  trial victory for client Quicken Loans in Henry vs. Quicken Loans Inc. (US District Court, Eastern District of Michigan). Mr. Davis led the Mayer Brown team that defended the fifth-largest retail mortgage lender in the United States against a class action complaint brought by former mortgage loan officers at Quicken, who claimed the company violated the Fair Labor Standards Act (FLSA) for failing to pay overtime for working more than 40 hours a week. Quicken maintained, and the court agreed, it was not required to pay overtime because the plaintiffs were highly compensated financial professionals who were covered by the FLSA’s administrative exemption.

The article characterized  Mr. Davis’ win as “…a rarity in wage-and-hour disputes that not only saved Quicken millions of dollars,  but also set a precedent for other FLSA suits brought by mortgage loan officers.” Mr. Davis said  the victory was “one of the proudest moments of his career,” which spans 18 years with Mayer Brown. 

Mr. Davis’ practice focuses on trial and appellate ERISA litigation, where he represents plans, fiduciaries, plan sponsors and service providers in ERISA investigations and litigation. He has worked on more than  100 FLSA and state wage and hour cases, including collective action and class action certification and decertification issues, enforcement of arbitration agreements when class action claims are involved and notice and discovery in class action cases.

Mr. Davis joined Mayer Brown in 1991 after serving as the Solicitor of Labor for the US Department of Labor and as Chief of Staff to the US Secretary of Transportation. He received a JD magna cum laude from Georgetown University Law Center, an MPA from Syracuse University, an MA from Boston University and an AB from Brown University.
